Kelly v. Phillip Morris Inc., 06-1756

In a suit against a manufacturer and a seller of tobacco products, removal to federal court is reversed and remanded where the Supreme Court's unanimous rejection of the defendant's materially identical arguments for federal jurisdiction under the federal officer removal statute in a functionally identical case controlled the case at hand and rendered removal inapposite.
