Hess v. Reg-Ellen Mach. Tool Corp. Employee Stock Ownership Plan, 06-2797

In an ERISA suit regarding plaintiffs' requests for a rollover distribution and a segregation and liquidation of their accounts under their former employer's stock ownership plan, judgment for defendant-employer is affirmed where the plan's rejection of the rollover request was not arbitrary and capricious, and the plaintiffs failed to exhaust their administrative remedies for their segregation and liquidation claim.
