Hicks v. Midwest Transit, Inc., 05-4523

In a cross-claim by a director of a company to recover on trailer leases entered into between the director and the company, dismissal of the claims is affirmed where: 1) the Illinois Director Conflict of Interest statute applied to the leases in question; 2) the cross-claimant's evidence was insufficient to create a genuine factual dispute regarding the fairness of the leases; and 3) the district court did not abuse its discretion in denying the cross-claimant's discovery requests aimed at augmenting his settlement recovery.
