US v. Webster, 06-4430
Sentence for a battery that occurred on an Indian reservation is affirmed where a sentencing enhancement for the infliction of permanent or life-threatening injuries based on the victim's facial scarring was appropriate since an impairment that has not been corrected by the time of sentencing, and will last for life unless surgically corrected in the future, should be treated as permanent under the Guidelines unless future correction would be a straightforward procedure.
