Holy Virgin Protection Cathedral v. Chertoff, 06-3387

In a challenge to the denial of an immigrant visa by a religious organization seeking to obtain the visa for an employee under the special immigrant provisions for religious workers, dismissal of the suit is affirmed where a decision by the Secretary of Homeland Security to revoke a previously approved visa is one that is specified to be in the discretion of the Secretary, thus the court lack jurisdiction to hear the case.
