Chen v. Gonzales, 06-3189

Petition for review of a denial of an application for asylum is denied where an asylum application based on a change in personal circumstances that is filed after the entry of a removal order and after the deadline to file a motion to reopen removal proceedings has passed is evaluated under the rules for an untimely reopening of removal proceedings, which do not take a change in personal circumstances into account.
