Pisciotta v. Old Nat'l Bancorp, 06-3817
In a suit representing a putative class of people alleging that their personal information had been compromised as a result of a bank's failure to adequately secure its website, dismissal of the complaint is affirmed where Indiana law does not consider that the harm caused by identity information exposure, coupled with the attendant costs to guard against identity theft, constitutes an existing compensable injury and consequent damages required to state a claim for negligence or for breach of contract.
