US v. Feliciano, 06-3423

Sentence for distribution of methamphetamine is affirmed where the district court's use of a state conviction for purposes of calculating defendant's criminal history did not present grounds for vacating the sentence despite the fact that the conviction resulted from a proceeding during which defendant was not represented by counsel since the defendant had adequately waived his constitutional right to counsel.
