In the Matter of the Complaint of: IL Marine Towing, Inc., 06-2104

After the filing in state court of a personal injury and wrongful death suit involving a boating accident, grant of the claimants' motion in the district court to modify a stay of the state court proceedings entered upon defendant's petition claiming immunity from liability under the Limitation of Shipowners' Liability Act is affirmed where the claimants' stipulations adequately protected the defendant's right to seek limitation of liability and have all limitation issues decided in federal court, thus the district court did not abuse its discretion in lifting the stay of the claimants' state court action.
