US v. Global Distribs., Inc., 06-3003
In a civil action against a distributor for failing to demand proof of identity from purchasers of a cold medicine containing pseudoephedrine, summary judgment for the government is affirmed where the defendants failed to comply with the identification requirements, but the matter is remanded for reconsideration of the penalties where the district court may not have taken some of the ameliorating factors adequately into account in imposing the maximum penalty for each transaction.
