United States Seventh Circuit

Conviction on drug and weapons charges is affirmed over defendant's arguments that: 1) certain evidence was seized in violation of his Fourth Amendment rights and should not have been admitted; 2) suppression hearings and certain of the district court's actions violated the Fifth Amendment; 3) his sentence is unconstitutional because it is based on facts not found by a jury beyond a reasonable doubt; and 4) the distinction between powder cocaine and cocaine base in the USSG is unconscionable and unconstitutional.
