Jennings v. Auto Meter Prods., Inc., 06-2466

In a RICO suit alleging that defendant had given false information to the Patent & Trademark Office in order to deny plaintiff a patent on an automobile dashboard bezel, dismissal of plaintiff's case is affirmed where: 1) plaintiff could not show a sufficiently lengthy period to support a RICO allegation; 2) plaintiff did not allege a sufficient number and variety of predicate acts to show a RICO violation; 3) plaintiff was the only identifiable victim; 4) plaintiff suffered only one articulable injury; 5) plaintiff also failed to show a violation of state RICO law; and 6) other state law claims were not ripe for review.
