Gradel v. Piranha Capital, LP, 06-4041
In a suit involving the control of property in parallel proceedings, a district court's order vacating the attachment of funds and denying turnover to plaintiffs is reversed where, as between two courts of concurrent and coordinate jurisdiction, the court which first obtains jurisdiction and constructive possession of property is entitled to retain it without interference and cannot be deprived of its right to do so.
