Ass'n Benefit Servs., Inc. v. Caremark RX, Inc., 05-4388

In a suit alleging fraud, unjust enrichment and breach of contract against a pharmacy benefit manager by a company formed to facilitate contracts between pharmacy benefit managers and organizations seeking administrators for their prescription benefit plans, summary judgment for defendant is affirmed where: 1) defendant failed to demonstrate the existence of a valid contractual obligation; 2) defendant failed to raise a genuine issue of fact as to fraudulent intent; and 3) plaintiff failed to create a genuine issue of fact as to the element of wrongdoing necessary to support its claim of unjust enrichment.
