Elkhatib v. Dunkin Donuts, Inc., 04-4190
In a suit alleging racial discrimination in violation of 42 U.S.C. sections 1981 and 1982 after plaintiff, a Muslim-American, was denied a relocation under a franchise agreement because of his refusal to carry pork products, summary judgment for defendant is reversed and remanded where plaintiff made out a prima facie case that the franchiser applied a franchise provision in a discriminatory manner, and the evidence was sufficient to allow a jury to find that defendant's stated non-discriminatory reasons for its actions were pretextual.
