In a federal lawsuit concerning a city's state suit to condemn a low-income housing complex, dismissal of the complex's complaint is reversed and remanded where: 1) 42 U.S.C. section 1983 allows a suit against state actors when the objective is to obtain a declaration that a rule of federal law supersedes the rules that the state actors are implementing; 2) partnerships, through the citizenship of their members, can sue under 42 U.S.C. section 1982; and 3) the complex had standing to pursue claims under the Fair Housing Act.
