United States Seventh Circuit

Rodriguez v. Chandler, 06-3995

A stay order of a district court grant of a petition for habeas corpus is kept in place for supplemental briefing where the Supreme Court's decision in US v. Gonzalez-Lopez, 126 S. Ct. 2557 (2006), that an erroneous failure to allow a defendant's chosen lawyer to represent him at trial violates the Constitution without regard to consequences does not apply retroactively to the current petition.
