United States Seventh Circuit
US v. Calabrese, 07-1962
Denial of defendants' motion to dismiss an indictment in a RICO prosecution for conspiracy to conduct an enterprise's affairs through a pattern of racketeering activity is affirmed over defendants' double jeopardy arguments where there was no basis at this preliminary stage for assuming that the government will fail to prove separate conspiracies.
