In a 42 U.S.C. section 1983 suit against a city alleging excessive force by a police officer, the city's appeal of a judgment for plaintiff is dismissed where the city failed to file a timely notice of appeal, and an order granting plaintiff attorney's fees is affirmed where: 1) the award was not clearly erroneous since the court did not rely on improper factors; and 2) the degree of plaintiff's success in the litigation did not require the district court judge to lower the fee award.
