In a suit charging a municipality with violation of the Religious Land Use and Institutionalized Persons Act, summary judgment for the city is affirmed where: 1) the Constitution does not forbid a state that has prevented a use of property by means of an invalid enactment to continue to prevent that use by means of a valid one; 2) the church's claim for damages was time-barred; and 3) the religious organization failed to show that the city's current ordinance imposed a substantial burden on its exercise of religious rights.
