In an insurance dispute over an errors and omissions policy, summary judgment for defendant-insurer is affirmed where: 1) Indiana law allows the use of interpleader as a method of paying the policy limits when legal claims exceed those limits; 2) the contract between the parties clearly instructs that the insurer was under no obligation to defend or to continue to defend plaintiff after payment of the policy limit to the court; and 3) the insurer did not breach its duty of good faith.
