Boumehdi v. Plastag Holdings, LLC, 06-4061

In a suit alleging violations of Title VII of the Civil Rights Act and the Equal Pay Act, summary judgment for defendant-employer is reversed where: 1) comments evincing anti-female animus can support a hostile environment claim; 2) a jury could have concluded that a reasonable person in plaintiff's position would feel she had no choice but to resign; 3) plaintiff provided evidence sufficient to survive summary judgment under the indirect, burden shifting method of proving disparate treatment; 4) a jury could have concluded that plaintiff's complaints triggered subsequent adverse actions; and 5) plaintiff's evidence was sufficient to create a genuine issue of material fact as to whether a pay disparity was justified.
