In a 42 U.S.C. section 1983 suit against two police officers brought by a former prisoner later pardoned on the basis of innocence, summary judgment for the officers is affirmed where: 1) evidence that the plaintiff pointed to as a Brady violation was neither favorable to his case nor suppressed by the officer in question; and 2) there is no relief available under Brady for an officer's false statement.
