Conviction and sentence for possession of a firearm by a felon are affirmed over defendant's arguments that: 1) the district court erred in denying his request for an evidentiary hearing on a motion to suppress the evidence obtained in a search of his residence; and 2) a jury should have found the fact of his prior convictions beyond a reasonable doubt in order for the court to impose a sentence under the Armed Career Criminal Act.
