US v. Simmons, 06-3894

Sentence for dealing firearms without a license is affirmed where: 1) the district court properly applied the sentencing guidelines and applicable enhancements; 2) the district court's failure to abide by proper sentencing procedure in granting a downward departure was harmless error since the benefit fell to the defendant; and 3) defendant's below-guidelines sentence was not unreasonable.
