US v. Roti, 06-3192
Conviction and sentence for bankruptcy fraud and concealing assets are affirmed where: 1) the district court properly excluded evidence of a settlement between defendant and his former attorney concerning the attorney's advice to engage in the fraudulent conduct; and 2) district judges are free to make findings of fact that influence sentences, provided that the sentence is constrained by the statutory maximum for each crime.
