Jaskolski v. Gonzales, 06-3508

In a suit where defendants accused of false prosecution for insurance fraud sought classification as federal employees for purposes of federal jurisdiction, defendants' appeal of the district court's denial of federal employee status is dismissed for lack of jurisdiction where a statute, as interpreted in Osborn v. Haley, 127 S. Ct. 881 (2007), that prohibits review of an order remanding a case back to the state court from which it was removed rendered the appeal unreviewable.
