US v. Harvey, 05-2897

Conviction and sentence for drug and weapons offenses are affirmed where a poorly worded indictment was not so defective as to require reversal under plain error review, and the district court's failure to determine the number of required drug tests, while error, was not so serious that it should be considered plain error.
