United States Seventh Circuit

Convictions for a drug conspiracy are affirmed where evidence suppressed by the government was not material given the overwhelming evidence against the defendants. Sentences for two defendants are remanded to determine whether the district court would impose the same sentence if required to resentence under an advisory Guidelines regime. Appeals for two additional defendants are dismissed where one defendant's plea agreement contained a waiver of his appeal rights, and any potential appellate issue for the other defendant would be frivolous.
