United States Seventh Circuit
Fifth Third Bank, Indiana v. Edgar County Bank & Trust, 06-3238
In an adversary proceeding during a bankruptcy, the judgment of the bankruptcy court is affirmed where corporate officers of the bankrupt company entered into a mortgage that was properly signed and attested, thus proceeds from the sale of the property properly went to the bank rather than to unsecured creditors.
