Coffey v. Northeast IL Reg'l Commuter RR Corp., 06-2310
In a suit by a railroad engineer against his employer alleging negligence under the Federal Employers Liability Act and a violation of the Locomotive Inspection Act, summary judgment for defendant is affirmed where: 1) plaintiff did not make a prima facie case of negligence under FELA; and 2) plaintiff was not able to establish a case for negligence per se since he did not present evidence that would indicate a violation of railroad safety statutes or regulations.
