United States Seventh Circuit
US v. Carraway, 06-3226
Appeal from dismissal of a post-judgment motion seeking relief from a conviction and sentence resulting from a drug conspiracy is dismissed, and a certificate of appealability is denied, where the district court correctly treated the motion as a second or successive request for relief pursuant to 28 U.S.C. section 2255 and, because movant had not first sought the appellate court-s leave to pursue such a request, properly dismissed the motion for want of jurisdiction.
