In a suit between insurance brokerages alleging breach of a confidentiality agreement, summary judgment for defendant and award of attorney's fees and costs is affirmed where no reasonable jury could conclude that plaintiff's meager and inconsistent protective measures were sufficient to protect its information, thus the agreement was unenforceable under Illinois law. The district court did not err in awarding defendant attorneys' fees and costs as the substantially prevailing party under the parties' agreement since defendant prevailed completely on all of plaintiff's claims against it.
