MacGregor v. Rutberg, 06-2829
In a suit for defamation and breach of contract against an expert witness in a malpractice suit against the plaintiff, dismissal of the plaintiff's case is affirmed where: 1) there is an absolute privilege for statements in testimony or pleadings in a judicial proceeding, and that privilege extends to expert witnesses; and 2) membership in a professional organization does not create an implied right among members to sue each other for breach of the association's rules.
