Sound of Music Co. v. MN, Mining & Mfg. Co. (3M), 05-4109
Summary judgment for defendant is affirmed in a suit over the termination of a contract for background music services where: 1) defendant did not breach the contract since it terminated the agreement according to the contract's terms; 2) plaintiff was not entitled to relief under two state franchise statutes; and 3) the district court properly denied plaintiff's motion to amend its complaint to add a claim under the Illinois Consumer Fraud Act because the claim would not survive a motion for summary judgment.
