United States Seventh Circuit

Conviction and sentence for making false statements to banks and other financial institutions are affirmed where: 1) the requirement that testimony be taken under oath can be waived by defendant's counsel without direct waiver by the defendant personally; 2) defendant was not entitled to a reduction in his sentence because of his status as an alien; and 3) a sentence enhancement for risk of death or serious bodily injury was justified.
