US v. Spano, 06-1562

Sentences for a scheme to defraud the Town of Cicero, Illinois are affirmed where: 1) allowing the guidelines range for one crime to influence the sentence for another is not a violation of due process; 2) the trial judge was not unreasonable in denying a defendant's argument that his sentence should be reduced because of potentially harsh conditions facing him in prison as an ex-police officer; and 3) any error committed by the trial court in the sentencing of a third defendant was harmless.
