United States Seventh Circuit

Miles Distribs., Inc. v. Specialty Constr. Brands, Inc., 06-1992

In a suit by a distributor alleging violations of the Sherman Act and interference with a prospective business advantage, summary judgment for defendant-supplier is affirmed where: 1) the evidence presented did not support the antitrust claim under a horizontal group boycott analysis; 2) plaintiff did not show that a genuine issue of fact existed regarding an alleged price-fixing agreement; and 3) there was no illegal conduct to support plaintiff's claim of interference since there was no antitrust violation.
