Miller v. IL Cent. R.R. Co., 06-1909

Summary judgment for defendants in a personal injury suit concerning an auto-train collision is affirmed for most defendants where the plaintiff's negligence was the sole proximate cause of the collision, but reversed for defendant Illinois Central, the operator of the railyard where plaintiff suffered his injuries, where a reasonable jury could have found that the defendant was negligent.
