Chicago Dist. Council of Carpenters Welfare Fund v. Caremark, Inc., 05-3476

Dismissal of a suit for breach of fiduciary duties under ERISA involving a prescription drug management plan is affirmed where defendant was not acting as a fiduciary in any of the relevant actions detailed in the complaint, therefore plaintiff could not sustain a claim for breach of fiduciary duties.
