US v. Jung, 05-3718

Conviction and sentence for wire and securities fraud are affirmed where: 1) although the district court failed to apply the "more exacting standard [that] must be demanded for admission of statements by attorneys," the error was harmless; and 2) the district court considered and adequately discussed the factors in section 3553(a), chose a sentence within the advisory range of the 1997 Guidelines, and adequately explained the reasoning behind the sentence.
