Sallenger v. Oakes, 05-3470

Denial of motion for summary judgment in a 42 U.S.C. section 1983 suit alleging violation of the Fourth Amendment's right to be free from excessive force is affirmed where the police officers in question were not entitled to qualified immunity since the officers' use of force was objectively unreasonable according to the facts viewed in the light most favorable to the plaintiff for summary judgment purposes.
