N. Contracting, Inc. v. State of Illinois, 05-3981

Summary judgment for defendant-state in a suit alleging that a program designed to increase the participation of socially and economically disadvantaged individuals in Illinois highway construction subcontracting is unconstitutional is affirmed where the state had a compelling interest in remedying past discrimination and did not exceed its grant of authority under federal law.
