Kampmier v. Emeritus Corp., 06-1788

Summary judgment for defendant employer in a suit under ADA, Title VII, and ERISA is affirmed where: 1) plaintiff did not provide evidence of a disability and failed to identify a similarly situated individual that was treated differently; 2) plaintiff did not show gender discrimination through either the direct or indirect methods; and 3) plaintiff did not show retaliation under Title VII. The judgment is reversed where plaintiff was able to raise a genuine issue of material fact concerning sexual harassment by a co-worker.
