US v. Starks, 06-2784
Conviction for obstructing a government investigation is affirmed where: 1) defendant did not attempt to corruptly persuade a third party to destroy an affidavit, therefore the nexus requirement of Arthur Andersen, L.L.P. v. United States, 544 U.S. 696 (2005) was not relevant; 2) the charge involved two statutes that did not overlap, thus there was no multiplicity in the indictment; and 3) the actions of the district court judge cured any concerns about a duplicitous indictment.
