US v. Murphy, 06-1309

Conviction on multiple counts of filing fraudulent tax returns and failing to file tax returns is affirmed where: 1) defendant's claim that his Fifth and Sixth Amendment rights were violated failed because the Sixth Amendment does not protect defendants who engage in stalling tactics associated with selecting an attorney and the Fifth Amendment does not apply until the government seeks to use evidence against the defendant in court; and 2) any error in jury instructions did not prejudice the defendant.
