US v. De La Cruz, 05-1548
Convictions and sentences for misapplying public funds are affirmed where: 1) a municipality's ratification, or authorization, of an expenditure is not a complete defense to a federal criminal prosecution for misapplication of public funds; 2) the district court did not abuse its discretion in ruling that a proffered city legal opinion did not qualify under the public records exception; and 3) the sentencing judge did not commit clear error in calculating the loss amount for the offenses.
