Dismissal of a 42 U.S.C. section 1983 suit alleging that the government's refusal to grant access to the physical evidence underlying plaintiff's conviction for murder violates his federal constitutional rights is affirmed where such suits are cognizable under section 1983 but the statute of limitations bars the claim in this case.
