Summary judgment for workers' compensation carrier in a suit over the carrier's lien rights in a settlement agreement is affirmed where: 1) intervention is not a necessary prerequisite to the operation of statutory lien rights; 2) settling parties' noncompliance with insurer consent requirements does not extinguish the insurer's statutory lien rights; and 3) defendant agreed to assume all responsibility for satisfying plaintiff's lien rights.
