Rivera v. City of Chicago, 06-1318
Denial of costs to defendant-city following a grant of summary judgment in its favor in an action brought by plaintiff in an effort to collect on a judgment in a civil rights action against a former police officer is vacated and remanded where: 1) although the court declines to abolish the exception that allows indigent losing parties to avoid paying costs under Federal Rule of Civil Procedure 54(d)(1), it sets forth guidelines for its application; and 2) the district court abused its discretion in denying the city-s costs.
